- a device with Internet access;
- an up-to-date web browser (e.g. Chrome, Firefox, Safari, Edge) with JavaScript enabled;
- an active e-mail account;
- cookies are recommended to be enabled.
Using the Website involves the risks typical of the Internet. The Service Provider applies security measures appropriate to the nature of the services, in particular SSL/TLS encryption. The Service Provider makes every effort to ensure the continuous availability of the Website, while reserving the right to temporary technical interruptions.
§ 5. Services provided by electronic means
Through the Website, the Service Provider provides the following services by electronic means:
- presentation of the Salon’s offer (information about treatments, price list, the Shop’s offer);
- enabling the purchase of Vouchers and Products in the Shop together with online payment;
- redirection to the Booksy platform in order to book and pay for an appointment;
- newsletter subscription (on the basis of separate consent);
- enabling contact with the Service Provider.
Services provided by electronic means are free of charge, with the exception of the purchase of Vouchers and Products in the Shop and the fee for a booked Service. The contract for the provision of services by electronic means is concluded for the duration of the use of the Website; the newsletter contract — for an indefinite period, with the possibility of termination at any time.
§ 6. Booking and paying for an appointment (Booksy platform)
1. Appointments are booked, and payment or prepayment for an appointment is made, exclusively through the Booksy platform. The “Book” button on the Website takes the Client to the Booksy booking tool. The Service Provider does not operate its own appointment booking form on the Website.
2. A booking may be made by a person who is at least 18 years of age and has full legal capacity. A minor may use a Service only in the presence of a legal guardian or with the guardian’s written consent, which is verified before the treatment begins.
3. The contract for the provision of a Service is concluded when the Booking is confirmed by the Booksy platform in accordance with its terms. The rules for making and confirming Bookings, the available payment methods and any prepayment are determined by the Booksy platform.
4. Telephone bookings are entered by reception staff into the Booksy platform in order to maintain a single shared appointment calendar.
5. Booksy is an independent provider of the booking service and a separate controller of data in this respect. The rules for the operation of the platform are set out in the Booksy terms available on that platform’s website.
§ 7. Shop — purchase of Vouchers and Products
1. In the Shop, the Client may purchase Vouchers and Products. The information presented in the Shop constitutes an invitation to conclude a contract within the meaning of Article 71 of the Civil Code, and not an offer.
2. An order is placed by adding items to the basket, providing the data necessary to fulfil the order, accepting the Terms and the Privacy Policy, and making the payment.
3. The sales contract is concluded when the payment is credited by the Payment operator and an order confirmation is displayed to the Client. The Client receives the confirmation at the e-mail address provided.
4. The Voucher is delivered in electronic form (a PDF file) to the e-mail address indicated in the order, promptly after the payment has been credited, during the Salon’s opening hours.
5. Physical Products are delivered in the manner and within the time indicated in the Shop when the order is placed. The cost and method of delivery are presented before the order is placed.
6. If payment is not successfully made within the time specified by the Payment operator, the order is not completed.
§ 8. Prices, payments and invoices
1. Prices on the Website are gross prices in Polish zloty (PLN) and include all applicable taxes.
2. Payment for Vouchers and Products in the Shop is handled by the Payment operator PayPro S.A. (Przelewy24). The available methods (including card, BLIK and fast bank transfer) are determined by the Operator. Payment for an appointment is handled by the Booksy platform.
3. The Service Provider does not collect or store the Client’s payment card data — this data is entered directly in the Payment operator’s encrypted component.
4. At the Client’s request, the Service Provider issues an invoice. Invoices are issued in the Krajowy System e-Faktur (KSeF, National e-Invoicing System) in accordance with applicable law. The request, together with the invoice details (company name, address, NIP), must be submitted no later than on the day of the purchase or appointment.
§ 9. Rules for redeeming Vouchers
1. A Voucher entitles the holder to use Services at the Salon up to its amount (monetary Voucher) or within the scope of the Service indicated on the Voucher (Service Voucher).
2. A Voucher is valid for 12 months from the date of purchase; the expiry date is indicated on the Voucher.
3. After the expiry date, the Voucher becomes invalid and cannot be redeemed or exchanged for cash. Failure to use the Voucher within its validity period does not entitle the holder to a refund of the amount paid.
4. A Voucher is redeemed by arranging an appointment (by telephone or via Booksy) and presenting the Voucher before the Service begins.
5. A monetary Voucher may be redeemed multiple times until its value is used up. Where the value of the selected Service exceeds the value of the Voucher, the Client pays the difference. A Voucher cannot be exchanged for cash — neither in whole nor in part, nor with respect to any unused balance.
6. Cancelling or rescheduling an appointment arranged using a Voucher is subject to the rules set out in § 11. Failure to attend an appointment or cancellation in breach of § 11 may result in the Voucher being deemed used with respect to the Service concerned.
§ 10. Right to withdraw from a distance contract
A Client who is a Consumer or an Entrepreneur with consumer rights has the rights described below. Owing to the different nature of the subject matter of the contract, the rules differ depending on the type of contract.
10.1. Services booked for a specific date (no right of withdrawal)
Pursuant to Article 38(12) of the Consumer Rights Act, the right of withdrawal does not apply to contracts for the provision of leisure services if the contract specifies the day or period of performance of the service. Booking a Service for a specific day and time falls within this category — the Client does not have the 14-day right to withdraw from the contract relating to the booked appointment. This does not limit the right to cancel an appointment in accordance with § 11.
10.2. Vouchers
Until it is redeemed, a Voucher constitutes a voucher whose purchase at a distance is covered by the statutory 14-day right of withdrawal. A Consumer or an Entrepreneur with consumer rights may withdraw from the contract for the purchase of an unused Voucher within 14 days of receiving it, without giving any reason, by submitting a statement (e.g. by e-mail).
The Service Provider refunds the payment received within 14 days.
The right of withdrawal expires if the Voucher has been used (in whole or in part) before the withdrawal period ends, and it does not apply to Service Vouchers redeemed on a specified date (section 10.1).
10.3. Products (e.g. cosmetics)
The purchase of Products is subject to a 14-day right of withdrawal counted from the day on which the Product is taken into possession. This right does not apply, among other things, to a Product delivered in sealed packaging which cannot be returned after opening for health protection or hygiene reasons, if the packaging has been opened after delivery (Article 38(5) of the Consumer Rights Act).
A model withdrawal form is annexed to the Consumer Rights Act; the Client may use any unequivocal statement. The refund is made using the same means of payment as used by the Client, unless the Client agrees to another method.
§ 11. Cancellation, rescheduling and the course of appointments
11.1. Cancellation and rescheduling by the Client
1. An appointment may be cancelled or rescheduled free of charge no later than 24 hours before the scheduled time — by telephone (+48 602 766 441) or via the Booksy platform.
2. Cancellation less than 24 hours in advance or failure to attend without cancelling entitles the Service Provider to retain any prepayment made (if applicable) as compensation for the reserved time slot. The rules for prepayments and their refunds are determined by the Booksy platform.
3. Rescheduling an appointment depends on the availability of a time slot; when changing to a more expensive Service, the Client pays the difference.
11.2. Late arrival of the Client
1. The Service Provider may shorten the Service by the length of the delay in order to finish it at the originally scheduled time and avoid affecting subsequent Bookings; the full fee remains payable.
2. In the event of a delay exceeding 20 minutes, the Service Provider may refuse to perform the Service; the situation is then treated as failure to attend the appointment.
11.3. Cancellation by the Service Provider
1. In exceptional situations (including illness of the therapist, force majeure or a breakdown), the Service Provider may cancel an appointment or propose rescheduling it, informing the Client without delay.
2. In such a case, the Client may choose either a full refund within 14 days or a booking for another date at no extra charge.
§ 12. Rules for the provision of Services at the Salon
1. Services are provided on site at the Salon (ul. Malwowa 108, 60-185 Poznań) by qualified therapists. The Client should arrive 5–10 minutes before the appointment.
2. Health contraindications. Before the treatment, the Client is obliged to inform the therapist of any circumstances that may constitute a contraindication, in particular: pregnancy and the postnatal period; skin conditions, fresh wounds, burns, inflammation; cardiovascular diseases, hypertension, varicose veins, thrombosis; cancer; recent injuries, fractures, sprains; infectious diseases; any other concerns.
3. If material health information is withheld, the Service Provider shall not be liable for any adverse effects of the Service to the extent resulting from such withholding.
4. The therapist may refuse to perform the Service in the event of contraindications, intoxication with alcohol or other substances, aggressive behaviour or a lack of hygiene that makes the treatment impossible. In such cases, the fee for the booked appointment is non-refundable.
5. The Client is obliged to respect the property, the order of the premises and the peace of other Clients.
§ 13. Complaints
13.1. Complaints concerning Services and the operation of the Website
1. A complaint may be submitted by e-mail (marketing@magicbalispa.pl), by post (Magic Bali SPA, ul. Malwowa 108, 60-185 Poznań) or in person at the Salon.
2. A complaint should include the Client’s contact details, a description of the event, the date and time of the appointment (if applicable) and the Client’s request.
3. The Service Provider considers a complaint within 14 days of its receipt and informs the Client of the outcome. Failure to respond to a Consumer’s complaint within 14 days shall be deemed acceptance of the complaint.
13.2. Complaints concerning Products (conformity of goods with the contract)
Products sold to Consumers and to Entrepreneurs with consumer rights are subject to the provisions on the conformity of goods with the contract (Chapter 5a of the Consumer Rights Act). The Seller is liable for any lack of conformity of the Product with the contract that exists at the time of delivery and becomes apparent within 2 years. The Client may demand repair or replacement and, subsequently, a price reduction or withdrawal from the contract in accordance with the statutory rules. Complaints concerning Products are considered within 14 days.
§ 14. Out-of-court resolution of consumer disputes
A Consumer may use out-of-court methods of handling complaints and pursuing claims, in particular:
- the permanent consumer arbitration court at the Wojewódzki Inspektorat Inspekcji Handlowej (Provincial Inspectorate of Trade Inspection) in Poznań (al. Marcinkowskiego 3, 60-967 Poznań);
- mediation conducted by the Wojewódzki Inspektor Inspekcji Handlowej (Provincial Inspector of Trade Inspection);
- free assistance from the Miejski Rzecznik Konsumentów (Municipal Consumer Ombudsman) in Poznań (ul. 3 Maja 46, 61-728 Poznań);
- non-governmental organisations dealing with consumer protection (including the Federacja Konsumentów (Consumer Federation)).
Use of these methods is voluntary and requires the consent of both parties to the dispute. Information on the procedures is available on the website of the Urząd Ochrony Konkurencji i Konsumentów (Office of Competition and Consumer Protection, www.uokik.gov.pl).
§ 15. Promotions and discount codes
1. The Service Provider may organise promotions and discount campaigns; the detailed conditions are set out in separate promotion terms made available on the Website or at the Salon.
2. Promotions and discount codes cannot be combined, unless the terms of a given promotion provide otherwise, and cannot be exchanged for their cash equivalent.
§ 16. Newsletter
1. The Service Provider provides a free newsletter service (information about the offer, promotions and news) to the e-mail address provided, on the basis of separate consent.
2. The newsletter is sent via the provider MailerLite (UAB “MailerLite”, Vilnius, Lithuania). The User may unsubscribe at any time via the “Unsubscribe” link in the footer of the message or by contacting the Service Provider.
§ 17. Liability
1. The Service Provider is liable to the Client in accordance with the general principles of the Civil Code and the Consumer Rights Act.
2. The Service Provider shall not be liable for the consequences of the Client providing false or incomplete data, the consequences of withholding health contraindications, interruptions in the availability of the Website or the Booksy platform for reasons beyond the Service Provider’s control, or the operation of the Payment operator and the Booksy platform under the rules set by those entities.
3. The limitations of liability do not apply to Consumers or Entrepreneurs with consumer rights to the extent that they would be impermissible under applicable law.
§ 18. Personal data
The controller of personal data is the Service Provider. Detailed information on the purposes, legal bases and retention periods, as well as the rights of data subjects, is contained in the Privacy Policy available on the Website. With regard to appointment bookings, Booksy International sp. z o.o. is also a separate controller of data.
§ 19. Final provisions
1. In matters not governed by these Terms, the provisions of Polish law apply, in particular the Civil Code, the Consumer Rights Act and the Act on the Provision of Services by Electronic Means.
2. The Service Provider reserves the right to amend these Terms; it gives notice of each amendment by publishing the updated version on the Website together with the date on which it enters into force.
3. Contracts and Bookings concluded before the date on which amendments enter into force are governed by the Terms in the version applicable on the date of their conclusion.
4. Disputes shall be resolved by the court having jurisdiction under the provisions of the Kodeks postępowania cywilnego (Polish Code of Civil Procedure); this does not limit the Consumer’s rights arising from mandatory provisions of law.
5. These Terms enter into force on the date of their publication on the Website.
